The Role of Network Media in Judicature Restriction and Adaptation

从法理学视野出发,围绕网络媒体与司法的关系,论述当前网络媒体的发展特点对司法独立产生的"双刃剑"影响,提出司法改革应重视程序正义的价值以实现网络媒体监督下的司法公正,同时在今后我国包括《新闻法》在内的媒体立法中应当坚持理性而宽容的思路以最大程度的维护网络媒体的合法权利,实现网络媒体对司法的合法有效制约。

From the perspective of jurisprudence, we describe the influence of the present network media development on the judicial independence according to the relationship between the network and judicature, putting forward that the proeedural justice should be emphasized to realize the judicial justice supervises by network media during the judicial reform, and at the same time we should adopt the rational and tolerant attitude towards the media legislation such as Press Law in order to preteet the reasonable legal right of network media, realizing the effective and legal restriction of network media in judicature.
