论农村生态文明建设——以农民环保法律权利配置为视角

On Rural Ecology Civilization Construction:a Perspective of Farmers' Rights of Environmental Protection

目前农村的工业污染、生产污染和生活污染对农民的生活、健康以及农产品的安全构成了威胁。现有保护农村生态环境方面的法律仅主张农民作为义务的主体,难以发挥农民保护和建设农村生态环境的积极性。农民是农村土地所有权主体,有权管理自己的环境,他们应当是农村生态文明建设的权利主体。

At present, rural pollution from industry, production and life poses threat to the farmers＇ life, health and safety of agricultural products. However, the present law on ecological environment only regards farmers as subjects of duty, which cannot bring their initiative into play in protecting and constructing rural ecological environment. The farmers, as the owners of the rural land, should have the right of managing their environment. They should be the subjects of right in constructing rural ecological environment.
