论国防资产的法律保护

国防资产是国防活动的物质基础,如何以法治化为归依,实现其安全、完整与有效是当前国防建设的当务之急。国防资产具有社会性、公共性、专用性、封闭性特点,产权多级委托代理及内部人控制等问题的现实存在,决定了国防资产具有易致流失的天然缺陷。在对国防资产法治保护必然性及现行法制安排检讨的基础上,应当以制定《国防资产法》为核心,构建完善的国防资产法律保护体系,通过良法之治把国防资产流失的风险降低到最低限度。

National defense property is material basis of national defense activities. The first imperative of today＇ s national defense construction is how to realize its safety, completeness and effectiveness by legalization. National property features sociality, public character, specificity and closeness. The existent problems of property right multilevel consignation and insider control result in that national defense property is easy to lose, which is its natural defects. Based on the necessity to protect national defense property by operation of law and analyses of current law system, we should center on formulating ＇ national defense property law＇ , build perfect national defense law protection system and reduce the risk of national property loss to the minimum through perfect law.
