论货物多式联运合同的法律适用

On the law application upon the contract of multimodal transportation of goods

多式联运是将多种运输方式联合起来进行运输的一种独立的运输方式,其本身所具有的不同于单式运输的特点,决定了多式联运合同法律适用更为复杂。目前有关多式联运合同法律适用的研究大多只针对国际多式联运合同。从国际多式联运合同和国内多式联运合同角度对多式联运合同的法律适用问题进行分析和探讨。

Multimodal transport is an independent mode of transport which is combined by several different modes, the characteristics of multimodal transport that differ from unimodal transport decide the more complexity of application of the law in multimodal transport contract. At present, most of the research on the multimodal transport contract focus only on the international multimodal transport contract itself, this paper analyses and discusses the law application not only in the international multimodal transport contract hut also in the domestic multimodal transport contract.
