就仲裁裁决理由的问题展开讨论,分析附具裁决理由的原因,探讨附具裁决理由的合理长度及详尽程度,论述裁决理由应该针对之处,并对法院自由裁量权下和仲裁员自由裁量权下作出的裁决、仲裁庭成员之间的合议以及仲裁机构作出的决定是否需要附具理由进行深入探究。
This paper mainly analyzes the reasons for arbitral awards. Firstly it analyzes the grounds for attaching reasons for arbitral awards, explores the reasonable length and level of detail of the reasons, and then discusses the respects which the reasons should target at. Meanwhile, this paper makes an in-depth inquiry on whether or not to attach the reasons when the arbitral award is made under the court＇s discretion or under the arbitrator＇s discretion or under the arbitral tribunal＇s internal deliberation or under the arbitration body＇s decision.
