国际法的“合法性”根源、功能以及制度的互动 --一种来自国际机制理论视角的诠释

International Law:The Source of Legitimacy,Enforceability,and Interplay of International Institutions

国际关系理论与国际法学之间关系紧密、相辅相成,而国际关系理论中的国际机制理论是两个学科跨学科合作的桥梁或纽带。实际上,国际机制与国际法是一个相近甚至是重叠的概念,两个学科是从不同角度对相近乃至叠合的事物展开的不同分析,因而它们之间有着巨大的合作潜力与前景。站在国际法学的角度,国际机制理论中有关国际机制的合法性根源、功能以及机制的互动等研究成果为国际法的相关分析提供了良好的借鉴。当然,其中存在的不足也必须引起我们的注意。

The IR theory and international law are closely connected and complementary to each other,and,between them,the international regimes theory is the bridge for interdisciplinary cooperation. Actually,the international regimes and international law are only different analysis from different angles to the similar or overlapped issues,with great potential and prospects for cooperation. The demonstration of the source of legitimacy,enforceability and interplay of international institutions by the school of international institutions in IR,illuminate the further study on the issues of international law.
