P2P下载的版权补偿制度的两种模式分析

P2P Download and Copyright Compensation Systems:Two Models

文摘P2P下载对版权保护制度提出了挑战。传统观点多认为P2P传播和下载是一种侵权行为,甚至触犯刑事法律。基于利益平衡原则的考虑,为促进新兴网络技术的健康发展,在解决P2P下载法律困境时,可以引入版权补偿制度。我国学者已提出版权补偿制度,但对其不同模式却不大关注。有必要对行业协会集体管理和补偿制度、国家宏观调控和征税补偿制度这两种可供选择的版权补偿制度安排进行分析和比较。从当代社会治理的理念出发,P2P下载版权补偿制度应该选择行业协会版权集体管理和补偿制度。

P2P downloading has challenged the copyright protection system. Traditionally, P2P dissemination and downloading is considered as an infringement, even as a crime. Based on the principle of ＂balance of interests＂, in order to facilitate the healthy development of internet technology, an ahemate copyright compensation system can be introduced to solve the legal dilemma of P2P downloading. Chinese scholars have already proposed the copyright compensation system; however different models of it have been ignored. It is necessary to analyze and compare two different options of copyright compensation system, i. e. , copyright compensation managed by a non - governmental collective administrative society, or, copyright compensation administered by the state through a levy under its macro control power. From the modem concept of governance, the choice should be the copyright compensation system managed by a non -governmental collective copyright administrative society.
