摘要
行政解释近年来开始受到关注,研究的视角在逐渐的开阔,取得了一定的成果。但是,行政解释的研究始终在做着现行法律规定的注脚,几乎是纯粹地进行着固守法律文本的解释,这与法律解释的发展趋势和依法行政的现实需要极不相符。行政解释应该在行政解释主体、对象与司法审查方面实现回归与创造,行政解释的再定位已经不容忽视。
The administrative interpretation has become a focus in recent years and its research perspectives are wider. But the traciitional study on it has been being the footnote of the current law stipulation that explains the legal text, which is not in accordance with the development of the legal interpretation and the demand of the administration according to law. The administrative interpretation should realize its return and from the aspect of administrative interpretation main body, object and the judicial review. It＇s essential to determine its new position in the studies.
