《周礼》有关财产损害赔偿规定探微

《周礼》保存了不少先秦的法制资料,其法律史料价值颇受关注。很多学者根据其记载的法律资料,在礼、刑、民、政、诉讼等法律规范方面进行了研究,但对其所反映的损害赔偿规定未有专文考察。从《周礼》所见的法律资料,结合金文、传世文献的相关记载可知:损害赔偿作为一种法律规范,在先秦社会就已有之。

According to its record the legal material, many scholars have conducted certain research in the criminal activity, civil, legal standard aspects and so on. But they have not conducted the special research in the property damage compensate stipulation aspect. According to bronze article, historical document and legal material recorded in ＂Zhou rite＂, we can draw the conclusion that it had the damage compensate legal standard in the pre-qin society.
