论我国违约金制度的完善

Perfection of the System of Liquidated Damages in China

违约金制度在诞生之初便在合同实务中扮演着重要的角色,然而关于违约金的争论至今依然存在。本文通过对违约金制度的发展历程、违约金的性质及我国违约金制度的现状进行探析,提出完善我国违约金制度的建议,以期能有助于完善我国的违约金制度,保证交易安全,促进经济发展。

The system of liquidated damages has played an important role in practical contacts since it comes into being,however,controversies about liquidated damages still exist now.On the basis of analyzing the development of the system of liquidated damages,the nature of liquidated damages and the current situation of the system of liquidated damages in China,some suggestions on perfecting the system of liquidated damages are put forward to guarantee safe business and accelerate the development of economy.
