摘要
劳动教养是我国迄今为止存在问题多、涉及领域广、矛盾非常尖锐的一项法律制度,在法律的位阶、实体上的确定性、程序上的正当性、执行的合理性等各方面都存在问题。因此,建立一套符合法治要求和时代特征,更加科学、规范、高效的具有中国特色的司法处分法律制度,以实现劳动教养制度实体确定、程序正当和执行合理等司法化之目的就显得尤为重要。
The present reeducation through labor system of our country is a kind of law system which exists a lot of problems, involves very widely scope and exists very much sharp antinomy so far. It exists a lot of problems from the angles of the rank of the law, the assurance of the entity, the rationality of the executive and the proper of the procedure. The author of this article thinks that our country should build up a kind of judicatory punish law system having Chinese special features which is more science , more normal, more efficient. Only so, we then can carry out a target that make the re-education through labor system be more legal and more proper.
