摘要
在企业年金制度中,职工既是企业年金的委托人,又是年金的受益人,并且具有不同于普通信托中的无偿受益人的特点。而职工在企业年金的运作中,和另一个委托人企业以及受托人相比较,职工往往处于弱势,如何平衡职工和企业之间、职工与受托人之间的关系,不仅需要立法上明确职工作为委托人的身份,强化其作为委托人和受益人的权利,同时还需要发挥工会在企业年金中的作用,建立完善的信息披露制度,保障其知情权及监督权的实现,充分维护职工的合法权益。
In the system of enterprise annuity ,workers and staff members are client,but also beneficiary.They are different from the free beneficiary in the common trust relationship.During the operation of the enterprise annuity,compared with another client--enter- prise and trustee,workers and staff members are always disadvantageous. How to keep their relationship balanceable?We should make it clear that workers and staff members are the client,but also strengthen their rights as client and beneficiary,bring the function of trade union into play, set up a perfect system of information disclosure.
