摘要
农村人口受教育权保障对于和谐社会构建具有重大意义,但是我国农村人口受教育权保障的现实始终未能得到真正实现。因此,我们应从受教育权的性质入手,合理分析其应然权利内容和义务主体,在此基础上,对照受教育权的上述应然要求寻找我国的现实差距并最终建立涉及立法、行政与司法的全方位农村人口受教育权宪法保障体系,从而在根本意义上实现对农村人口受教育权的长效法治保障。
It is significant to build a harmonious society that guarantee rural population' s rights to receive education for building a harmonious society, but it has not got realized in China. Therefore, we have to start with the nature, then analyze the claims and subjects of duties rationally. On this basis, contrasting with requirements of rights to receive education, we fill up the gap between China and foreign countries, and eventually establish an all-dimensional constitutional guarantee mechanism of rural population' s rights to receive education involving Legislative, Executive, and Judicial. Accordingly, a long-term guarantee of rural population' s rights to reeeive education will get realizzed radically under the rule of law.
