摘要
网民发动"人肉搜索"的目的不只为了获取当事人的有关信息,而是要通过对搜索对象真实信息的揭露,来表达意见、态度和情绪。因此,"人肉搜索"在本质上不过是一种舆论表达,是网络舆论的一种形式。对于"人肉搜索"的规制,必须处理好个人隐私与言论自由、个人利益与公共利益的平衡,必须考虑社会核心价值的维护和道德评判的标准。
The ultimate intention of Renrou online search （manpower online search）, a new phenomenon in China, is to express netizens＇ opinion, altitude and feeling by means of the exposition of facts from the objects searched. So this behavior is essentially the expression of public opinion and the form of Internet opinion. As for the regulation for Renrou online search control, the balance between privacy and free speech and between individual interest and public benefits must be well kept, and, simultaneously, the maintenance for the core values of society and the standard of moral judgment should be taken into consideration.
