关于中外合作办学机构终止的法律规定亟待完善

在中外合作办学机构终止不断增多之际,检讨和完善现行相关法律规定意义重大。立法过于简陋且存在重大瑕疵的现行制度设计,未能很好解决终止事宜,急需完善。完善中外合作办学机构终止的法律规定,应坚持优先保护受教育者权利和兼顾中外合作办学的双重性的原则,在重新构建中外合作办学机构运作模式的基础上,着重于对终止程序和财产清算规定的完善。

When the termination wave of Sino-foreign cooperative educational institutions is surging forward, it is of great significance to self-criticize and perfect the related legislation. The current system design with excessively simple legislation and great deficiency has failed to settle the termination affairs well, starving for perfection. In order to perfect the legislative termination of Sino-foreign cooperative educational institutions, we should adhere to the principle of taking the priority to protect the rights of the educatees and give attention to the dualism of Sino-foreign cooperative school running, and emphasize the perfection of the termination procedures and the stipulations on liquidation, based on re-constructing the operating mode of Sino-foreign cooperative educational institutions.
