On the Legal Environments of Private Enterprise and the Necessity of Its Self-optimizing

本文站在民营企业角度从三个层级论述了民营企业法律环境及其优化的必要性。民营企业法律环境的三个层级分别是内部法律环境、市场法律环境和社会法律环境,关注三个不同层级的法律环境有不同的价值。文章最后从外部性理论视角进一步分析了民营企业法律环境自我优化的必要性。

Standing on the point of private enterprise, this essay discusses the legal environments of private enterprise and the necessity of its self--optimizing from three levels. The three levels of legal environments are inner--legal environment, market legal environment and social and legal environment. The values of the attention paid to different level of legal environments differ from each other. This essay analysising the legal environments of private enterprise and the necessity of its self--optimizing is mainly in the methodology of law and economics. At the last part of this essay, it further discusses the necessity of self --optimizing its legal environments from the view of externality theory.
