为配合监管部门对问题金融机构的行政处置,法院往往会发布"三中止"通知,对涉及相关金融机构的案件暂缓受理、中止审理或者中止执行。"三中止"措施的适用一定程度上是符合我国金融业发展的现实需要的,但对其合法性问题一直存在争议。对于该项制度的未来发展,需要在法律授权的明确性和程序的规范化等方面进行改善。

In order to coordinate supervisors＂ administrative disposal upon problematic financial institutions, courts tend to release ＂three terminations＂ notice, which include suspension of case accept, termination of hearing proceedings, and termination of execution proceedings. The application of ＂three terminations＂ measurement is, to some extent, in line with the realistic requirement of China＇s financial industry development. However, the legality of ＂three terminations＂ is continuously controversial. For future development, the clarity of legal authority as well as the standardization of procedures should be further improved.
