社会转型期人民陪审员制度之完善

On Perfecting People’s Juror System during Social Transforming Period

目前中国正处于社会转型时期,法律制度也在变革之中。人民陪审员制度作为体现和发扬司法民主的一种形式,在构建社会主义和谐社会的过程中,发挥着重要的政治价值、法律价值与社会价值。然而,人民陪审员制度在其实际运行过程中,依然存在着一些缺憾。因此,我们有必要探讨人民陪审员制度发展的历史,将其与西方陪审制度进行比较分析,并结合《关于完善人民陪审员制度的决定》,就当下我国人民陪审员制度的完善提出建议。

Now China is in the period of social transformation, and the legal system is in the reformation too. The people＇s juror system as a form of judicial democracy plays an important political, legal and social value in the process to construct a socialist harmonious society. However, in the actual operation process, there still exist some shortcomings in the people＇s juror system. Only exploring the history of the development of the people＇s juror system, comparing it with the western jury system, and combining the Decision on Improving People＇s Juror System, can our people＇s juror system be improved.
