The Debate of the Relationship between Judicial Justice and Judicial Authority——Maintaining the Judicial Authority and Keeping the Judicial Justice

追求司法公正是在应然层面上法律所永恒追求的价值,而维护司法权威则是在实然上树立司法独立形象的必然。实际上,树立司法权威也是为司法正义的实现打下坚实的基础。然而,在实践中,两者却貌似水火不容,冲突极大。一些当事人、大众传媒往往为了实现个案正义,不惜以冲击、诋毁司法机关为代价,致使一些司法机关名声恶播,甚至严重影响了司法机关的工作。因此,如何协调司法公正与司法权威成了当务之急。

Pursuing the judicatory justice is the forever value that law pursues, however maintaining the judicial authority is inevitable in setting up judicial authority. Actually, setting up judicial authority is the base of realizing the judicial justice. However in fact, both of them conflict quite a lot. Some parties and the public media usually for carrying out individual case justice, don＇t hesitate to take pounding at slandering judicial organ as for the judicial justice, leading to the bad fame of some judicial organ and seriously influencing the normal work of the judicial organ. As a result, it is an urgent matter about how to moderate the judicial justice and judicial authority.
