Mediation:Another Option to Realize Justice——Based on the movie "The Story of Qiu Ju"

文章从电影《秋菊打官司》说起,引出了论述主题。首先回顾了我国重视调解的法律传统,然后重点论述了调解制度在我国法制现代化过程中的现实意义,即调解也是实现公义的另一选择。调解能够实现公义的内在依据主要有两点:一为其当事人主义的本质;二为调解有利于社会关系的全面修复。

Based on the movie ＂The Story of Qiu Ju＂, this article explores the function of civil mediation in China. Having examined China＇s judicial tradition that attaches much importance on mediation, it then focuses on discussing the role of civil mediation in the modernization of judicial system in China. The author argues that, except suit, civil mediation is another option to realize justice. Mediation can not only maintain the legal rights of the parties concerned, but also help to recover the relations between them.
