我国离婚损害赔偿制度存在着不足,现实婚姻生活中也有建立婚内侵权责任制度的需求,但不能用婚内侵权责任制度修改离婚损害赔偿责任中的离婚要件。婚内侵权责任制度与离婚损害赔偿制度是并行的两个不同的制度,有着不同的功能、构成要件,两者在一定程度上存在着竞合关系。
