论女性能否单独成为强奸罪的主体

强奸罪是一种发生率极高、影响极为恶劣的犯罪,传统理论和司法实务认为强奸罪的主体只能是男性,但是女性强奸男性的状况在现实生活中一直存在,本文从女性可以成为和应该成为强奸罪的主体两个方面论证了女性成为强奸罪主体的存在可能性,以期能对司法实务和立法提供一些参考。

Rape is the crime which the incidence is a very high and has an extremely, bad effect. In the traditional theory and judicial practice, male is considered the only subject of the crime, but in real life, there does exist the phenomena that women rape men .This paper analyzes the possibility that a woman can be and should be the subject of rape to provide some references for the judicial practice and legislation.
