建立非法证据排除规则不仅是保障人权、维护法治尊严的需要,而且还能够促进发现案件的实体真实。笔者从我国确立和完善非法证据排除规则的必要性出发,分析在我国建立非法证据规则需要正视的问题,进而探讨了在我国建立完善的非法证据排除规则应当确保的措施。
