法治视野中的离婚自由

婚姻自由包括结婚自由和离婚自由两个方面。保障离婚自由是婚姻自由原则的基本要求,没有离婚自由,婚姻自由就失去了应有之意和存在的根基。有必要在法治的视野下审视婚姻法中的离婚制度存在的问题,以期完善婚姻法中的离婚制度,实现真正的婚姻自由。

The freedom of marriage includes the two aspects in marriage and divorce. To protect the freedom to divorce is a basic requirement in the principle of marriage freedom. There is no divorce freedom, and there is no groundwork for its existence. It is necessary to examine some existing problems in the divorce system from the perspective of law, in order to perfect the divorce system in the Marriage Law and to achieve true freedom of marriage.
