基于专利质量的两阶段专利资助政策研究

Study on the Two-stage Patent Funding Policy Based on the Quality of Patent Application

分析了当前上海市专利资助政策存在的问题,提出了基于专利质量的两阶段专利资助新政策,即管理部门在专利申请人提出申请时给予部分资助,而当专利申请获得授权后再给予另一部分资助.研究结果表明,这种新的资助政策在奖励高质量专利申请人的同时,还能甄别已申请专利的质量高低,进而对高质量的专利申请给予优先审查,以提高专利申请过程的效率.

The defect of current patent subsidy policy in Shanghai was analyzed and a more efficient policy based on the quality of the application was proposed. Under the proposed two stage subsidy policy, the applicants are charged differently at the first stage based on the quality and awarded differently based on the first charge when the applications are authorized. Meanwhile, the applicants with different quality will choose different funding combinations and thus are screened. The advantage of the new policy lie in the fact that it can award more and give priority in examination for the higher quality applicants and thus improve the efficiency of the patent system.
