从WTO争端解决实践看风险预防原则的适用被引量：6

摘要风险预防原则的精髓在于强调当有环境风险发生或发生之虞时,不应以缺乏科学确定性为由而限制必要措施的实施。根据WTO争端解决实践,为避免引发不必要的贸易争端,我国在适用风险预防原则对具有科学不确定性的环境风险进行防范时应考虑以下因素:风险阀值,相关科学证据的充分性,成本与效益,所采取措施的非歧视性与一致性,相关科学技术的发展,防范措施的定期审查与适时调整。
