试论破产管理人与重整人的设置——以清算程序与重整程序的比较研究为视角

On the Deployment of Bankruptcy Assignee and Reorganizer

管理人制度的设计是破产法中的一个重要内容,《破产法》统一规定了管理人制度。但清算程序与重整程序具有不同的特点,应根据这两个不同的程序,对破产管理人制度和重整人制度进行各自不同的立法设计,以更好地实现破产法的宗旨。

Bankruptcy Law provides a clear definition of the assignee system. But the settlement procedure and reorganization procedure have different characteristics. So proper arrangement is needed to be designed for both bankruptcy assignee and reorganizer in accordance with these two procedures so as to fulfill the function of Bankruptcy Law.
