Exploration of Sentencing Proposal in the Procuratorial Organs of Sichuan Province

在对四川省检察机关量刑建议改革情况进行实证分析的基础上,本文总结了量刑建议改革试点工作基本规律、对量刑建议的规制,初步评估了量刑建议改革成效,在此基础上,从量刑建议的适用范围、应遵循的基本原则、提出的方式、提出的内容以及量刑建议纳入法庭审理的程序等方面对量刑建议走向进行了展望。

This article empirically analyzed the procuratorates＇reform of sentencing proposal in Sichuan province, summarized basic rules in the pilot reform and the regulation of sentencing proposal, and elementarily evaluated the effect of this reform. Based on the analysis above, this article anticipated the direction of the sentencing proposal from several aspects including the scope of application, the basic principles, the forms and the contents of the proposal, and how to bring the sentencing proposal into court hearing
