审查逮捕阶段律师介入机制的探索

Exploration of the Mechanism of Lawyer's Intervening the Phase of Examination and Approval of Arrest

为优化批捕诉讼构造、畅通侦查监督线索,提高审查批捕案件质量,海淀区人民检察院于2008年6月1日制订出台了《律师介入审查批捕程序办法(试行)》。在对该机制一年来的运行情况和取得的成效进行考察的基础上,从告知、申请会见、提交材料、审查核实、配套措施等五个方面对该机制的规范完善进行了探索。

Haidian district procuratorate enacted on 1 st June 2008 the ＂ Experimental Rules of Lawyer＇s Intervening the Procedure of Examination and Approval of Arrest＂ in order to optimize the procedural structure of approval the arrest, make convenient for grasping the clue on investigation supervision, and improve the quality of cases applying examination and approval of arrest. Based upon the review of the running situation and effect of the mechanism during more than one year, improving and regularizing methods were explored from five aspects including notice, application for meeting the suspects, submitting materials, examination and verification, and relevant measures.
