摘要 我国法律规定,企业要实行不定时工时制度或综合计算工时制度,除要具备规定的生产或工作特点条件外,还必须要向国家劳动行政部门履行审批手续,只有获得国家劳动行政部门的批准才能实施指定的弹性工时制度。金融危机爆发后政府由严格控制转变为鼓励企业实施弹性工时制度。因此政府必须要处理好"维稳"和"维权"的关系;处理好行政能动和司法理性的关系;建立弹性工时制常态化的审查机制,赋予司法对弹性工时制度实施的最终审查权。 According to Chinese law, the enterprises have to go through the examination and approval procedure from the administrative department of labor in addition to having the conditions of production or working characteristics and then implement the system of flexible working hours or the system of comprehensive working hours. After the outbreak of financial crisis, the government has changed the system from strict control to encouraging enterprises to implement the system of flexible working hours. Therefore, the government must deal with the relationship of "keeping stability" and "upholding rights" and that of administrative initiative and judicial rationality well, establish the review mechanism of normalization of system of flexible working hours and empower administration of justice with the final judicial review on implementation of system of flexible working hours.
