高校招生权的法律性质与司法审查——对“罗彩霞事件”的行政法透视

随着高校诉讼案的增加,高校的法律地位问题引起了学术界、司法界的广泛关注,形成了事业单位法人、公法人、公法人中的"特别法人"、法律法规授权组织、第三部门等不同观点。我国公立高等学校的法律地位具有三重身份,即事业单位法人、法律法规授权组织、行政相对人。高校招生权是法律法规授予高校的行政权力,在实施招生权的过程中高校与考生构成的是外部行政法律关系,当考生认为高校在实施招生权的过程中对其受教育权造成了侵害,适用于行政诉讼,可以寻求行政赔偿。
