和谐社会背景下非刑罚化探析

Analyzing Non- penalty in the Context of a Harmonious Society

在建设和谐社会的主题下,非刑罚化也逐渐受到了理论界和实务界的重视。但受各种因素的影响,非刑罚处罚方法在司法实践中的运用还很有限,非刑罚化的功能还未充分发挥。剖析非刑罚化在我国实践适用中存在的问题,提出对非刑罚化适用的具体完善。

Under the theme of building a harmonious society, non-penalty theory has been gradually importance. However, affected by various factors, the non-punitive methods of punishment in judicial practice are still very limited used. Non-penalty function has not been brought into full play. This article analyses some problems and proposes some measures about the non-penalty applied in practice in China.
