摘要
行政法具有技术性特点。技术规范不能作为道路交通安全法律体系渊源,但强制性技术标准作为技术规范和社会规范的双重载体,属于部门(技术)规章。强制性技术标准在行政法律体系中具有自己特有的功能定位和作用。
The administrative law had the technical characteristic. Technology standard cannot take the road traffic security legislation system origin. The compulsory technical standard takes the technology standard and the social norm dual carriers.It takes the department （technology） of the rules and regulations. Compulsory technical standard has its own functions in the the administrative legislation system.
