具体行政行为框架下的政府信息公开——基于已有争议的观察

需要通过"条例"来获得行政复议和行政诉讼保障的具体行政行为,在政府信息公开行为中只有依申请公开政府信息的行为一种。拒绝申请人公开政府信息的法定理由,应当是政府信息"涉及国家秘密、商业秘密、个人隐私"。以往以"内部信息"为由拒绝公开的原因在于行政机关没有将依授权制定的行政规范性文件的内容与政府信息公开规定保持一致,目前以不属于公开范围为由拒绝公开申请的行为不符合"条例"的规定。依申请公开政府信息的行为,可以设定与请求不一致的公开范围、政府信息内容和公开形式,甚至可以单方面设定附款。

Among the situations of disclosure of government information, there are only one sort of agency decision can be settled through administrativereconsideration or administrative litigation by application of ＂Regulation of the People＇ s Republic of China on the Disclosure of Government Information （RDGI） ＂, which is originally launched upon the application by certain applicant. The grounds for rejecting disclosure by law are that the government information is related to ＂State Secrets, Commercial Secrets or Personal Privacy＂. The reason for rejecting disclosure before was based upon ＂interior information＂ excuse, but the reality was that the administrative rules made by agencies upon authorization couldn＇t comply with the RDGI, which is infringed by the common practices with the reason of ＂beyond the scope of disclosure＂. As one sort of agency decision, the reply of agencies, the government information holders, can reset the scope, content and form of disclosure incompatibly, even the attached terms or requirements also can be added unilaterally.
