On the Limitation of the Patients' Informed Consent Right——Based on the Core Idea of Protecting Patients' Informed Consent Right

患者知情同意权是患者在疾病诊治过程中的一项基本权利。其保护应以"最大限度保护患者的人格权"为核心理念,在特殊情况下应对它给予适当的限制,主要涉及患者知情同意权已经或将要损害社会公共利益、已经或将要损害第三人的合法利益以及法律明确授权限制的三类情形。在患者有同意能力的医疗紧急情况下,应当对患者知情同意权予以特殊保护。

The patients＇ informed consent right in disease diagnosis and treatment is a fundamental right of patients. The core idea of protecting patients＇ informed consent right is to protect the patients＇ personality right to the maximum, and lay some limitation on it in exceptional cases. The limitation occurs in three situations： firstly, already or is going to harm the social public interests; secondly, already or is going to harm the third person＇s legitimate interests; thirdly, the conditions provided clearly by the law. Under the emergency when the patients have the consent capacity, the patients＇ informed consent right should be specially protected.
