少数民族习惯规范和国家法的冲突及互动——以景颇族为例

文章以景颇族为例,通过对田野调查案例的具体分析,把静态的习惯规范和动态的解纷过程结合起来,展示了景颇族习惯规范与国家法的冲突;进而分析了景颇族习惯规范至今仍然具有生命力的原因,并提出了实现二者良性互动的路径。

As an example of Jingpo, the author combines the static customary norms with the dynamic process of solving disputes by analysis of specific cases through field work, and displays the conflict and gambling between Jingpo customary norms and national law. Then the author puts forward the path to realize the interaction after the author analyzed the reasons that Jingpo＇ s customary norms still has strong vitality now. In order to promote the process of legal system modernization of Jingpo, the relevant national authority should attach importance to take and kindly treat the national customary norms.
