图书馆版权涉讼案件诉因、涉嫌侵权行为类型与相关法律问题分析

Analysis of Causes of Action, Types of Infringement and Related Legal Issues in Library Copyright Lawsuits

文章归纳了图书馆版权诉讼的侵犯信息网络传播权、署名权和作品原件所有权三个诉因,提炼了诉讼中涉嫌侵权行为类型,并对侵犯作品原件所有权、侵犯署名权、以镜像站点方式订购与使用电子文献数据库的法律问题以及网站深度链接问题进行了分析,为图书馆规避版权诉讼风险提供了相关建议。

This paper outlined three causes of action in copyright lawsuits libraries involved, that it is infringement of the information network communication right, right of authorship and original copy right of a work. And four types of alleged infringement are also be outlined and analyzed according to the laws. Finally, some suggestions for libraries have been given in an effort to avoid lawsuit risks.
