论综合生态系统管理理念的法律化——兼谈法律思维的作用

On the Concept of Integrated Ecosystem Management of the Law

我国环境资源立法和学术界均已接纳综合生态系统管理这一理念,但目前对这一理念的理解和运用还仅仅停留在表面层次,仅仅止步于在立法体系上较为全面地涵盖生物系统各要素,但由于该理念在我国与法律尚未进行良好对接,导致我国现有的众多环境资源立法从根本上来看并没能够真正有效地体现出综合生态系统管理理念。综合生态系统管理理念法律化的核心问题应当是从法律思维的角度出发,运用权利义务分析这一法律人特有方法对其进行解析。

Both China＇s environmental legislature and scholars have accepted the concept of the integrated ecosystem management （IEM）, but this concept has not been legally considered and used. Nowadays China＇s environmental legislature and scholars are satisfied with the Legislative system, which has covered almost all elements of the ecosystem. However, none of those existing environmental legislations can efficiently reflect the nature of the concept because this concept has not successfully merged with law. To merge the IEM and legislation together, the most significant issue is using the special method of right - duty analysis, which is the core of the legal thinking.
