Study on Attorney's Procuration System under the Transformation of Civil Proceeding Mode

我国民事诉讼"由职权主义诉讼模式向当事人主义诉讼模式转变"的大背景对律师代理产生着重大影响:当事人主义诉讼模式是律师代理生存的最佳环境。同时,律师代理在这一转型过程中为彻底实现诉讼当事人主义这一宏伟目标发挥着重要作用。为此,主张律师代理在某些特殊民事案件中的垄断地位即是本文突出强调与重点设计的一种途经。

The transformation of proceeding mode from authority - oriented to client - oriented has a profound influence on attorney＇s procuration： client -oriented proceeding mode has turned out to be the favorable circumstance for the existence of attorney＇s procuration. Similarly, attorney＇s procuration plays an important role to thoroughly realize client- oriented proceeding mode in the course of this transformation. Therefore, to advocate the monopoly position for attorney＇s procuration in some especial civil cases is an available alternative provided and highlighted in this paper.
