谈宽严相济刑事政策在公安工作中的运用

党的十六届六中全会指出,为构建社会主义和谐社会,加强社会治安的综合治理,要实施宽严相济的刑事政策。该政策的出台,为构建和谐社会提供了司法保障。公安机关作为刑事执法的重要部门,在执法活动中贯彻执行宽严相济刑事政策有其特殊的重要意义。在当前公安工作中,由于贯彻宽严相济刑事政策面临着重刑主义的司法理念阻碍、宽严相济具体措施缺乏明确的法律依据和统一的"宽""严"标准,从而导致操作困难。应以严格执法为着力点,以此推动实施宽严相济的刑事政策。

The 6^(th) committee meeting of the 16^(th) CPC Congress points out that,in order to set up the harmonious socialism society and strengthen comprehensive management of social public order,the criminal policy of Grace and Rigidness Functioning Together is carried out.The launch of the police aims to provide judicial guarantee for setting up a harmonious society.Public security organizations,as the important sections in criminal law-enforcement departments,carry out this policy in work,which has a significant meaning.But the fulfillment of this police meets the obstacle of the judicial concept of emphasizing serious penalty.The policy lacks of definite legal support and coherent standards.And it is not easy to operate.We should hold tight strictly enforcing the law and push implement of the judicial policy of'Grace and Rigidness Functioning Together'.
