我国立法中对土地承包经营权能否继承没有明确。土地承包经营权作为一种独立的用益物权,符合遗产的特征,应当成为继承权的客体。在土地承包经营权的继承中,需考虑土地承包经营权原始取得的身份性,以保证本集体组织的成员优先继承,从而保证农村社会的稳定。

In China s legislation,the inheritance right to contracted land management has not been clearly defined.As the independent usufructuary right,the right to contracted land management bears the characteristics of inheritance,therefore it should be the object of inheritance right.As for the inheritance right to contracted land management,the original identity of the right to contracted land management should be considered,and the priority right of its members can be guaranteed so as to maintain the social stability in the rural areas.
