摘要
农村土地承包经营权的财产增值功能和社会保障功能所体现的公私融合性,决定了农村土地承包经营权融资担保的最佳形式不是支配交换价值的抵押,而是可以支配使用价值的质押。农村土地承包经营权质押的构建,应当以公私融合的经济法为指引,借鉴我国历史上的"抵当"、"倚当"和国外的不动产质押、"出租质",进行具体的制度设计。
The best form of guarantee by the rural land contracting management right is not the mortgage through dominating the exchange value but the pawn which may dominate the use value. This is determined by the integration of public and private as embodied in the value-added function and social security function of the rural land contracting management right. For the construction of pawning of the rural land contracting management right should we draw on the practices in our country's history such "Di-dang" (balance pawn), "Yi-dang" ( leaning pawn) and those of overseas real estate pawns such as "rental pawns", and design the specific rules and regulations under the guidance of the public and private integrated economic laws.
