摘要
用人单位歧视性报复作为一种独立的就业歧视类型有着独特的表现形式,主要有不当解雇、降低职务、减少劳动报酬和福利待遇等。我国法律虽然对之作出了禁止性的规定,但是缺乏系统全面的规制。由于救济手段的缺乏,现有的法律规范不能提供理想的救济手段和救济结果,劳动者在遭受用人单位歧视性报复后难以得到有效地救济。为解决这一困境探求法律救济方法显得十分必要,以法律规制用人单位的行为,保护劳动者的合法权益,调整劳动关系。
Employer' s discriminatory Retaliation is a kind of independent type of employment discrimination which has unique forms, mainly including unjust dismissal, demotion, lowering labor remuneration and welfare treatment and so on. Although the law of our country has made prohibitive provisions, it lacks regulation system. For lack of remedies, the existing laws cannot provide the ideal remedy means and relief. Employees can not get effective remedies after they are discriminated. To solve this predicament, it is necessary to seek legal remedies, regulating employer's labor practices by laws, protecting the legitimate rights and interests of workers, and regulating labor-capital relations.
