海峡两岸著作权刑事立法比较与借鉴

Comparative Study on Copyright Criminal Legislation of Cross-straits

与台湾地区的著作权刑事立法相比,我国大陆的著作权刑事立法在价值取向、立法模式、保护范围、罪状设计等方面还存在一些不足。海峡两岸具有相同的文化渊源和背景,我们应根据《TRIPs协定》的要求,借鉴台湾地区著作权刑事立法的合理部分,完善我国大陆的著作权刑事立法,实现我国在加入WTO时的承诺。

Comparative to the copyright criminal legislation in Taiwan, there still existed some deficiencies in the aspect of the value orientation, legislative model, scope of protection, accusation pattern of China＇s criminal legislation. Cross-straits have the same origin and cultural background. We should actively learn from Taiwan＇s reasonable part in copyright criminal legislation, modify and improve it according to the requirements of the TRIPs agreement to meet the need of WTO commitments
