Violation of the Cooperative Principle and Information Obtaining in Courtroom Questioning

目前,国内的法律语言学的研究主要集中在司法环节,诸多研究的重点在于信息层面。以格赖斯的会话含义理论框架为指导,并结合此理论的合作原则及其准则,通过详细分析庭审过程中,法官,公诉人或律师在与被告(人)对话时,被告(人)违反会话合作原则的语言现象的研究,揭示解读违反合作原则及其准则,从而获取所需的有效信息在案件审理过程中的重要作用。

At present the judicial link is emphasized by the studies on forensic linguistics, which pay close attention to the information level. This paper is concerned with the linguistic phenomenon in the courtroom interactions. From the perspective of the theory of the conversational implicature, we will tend to explore defendants＇ violation of the cooperative principle when questioned by the judges, prosecutors or lawyers to reveal how they successfully make clear the implied meaning conveyed by the defendants through the violation of the cooperative principle and its maxims and how to get the necessary information for the case.
