摘要
在现实中,因第三人侵权引起的工伤事故时有发生,比如在上下班途中或在履行工作职责时被他人违章驾驶的机动车撞伤,就是典型的因第三人侵权引起的工伤,这就是使工伤保险与第三人侵权常常产生竞合。那么在产生竞合时,如何使用法律,对于受害职工或其亲属究竟应该得到怎样的赔偿,在司法实践中常引起大的争议。因此,就这一问题做出探讨,以期在司法实践中能起到一定的参考作用。
Because of the third people in fringe rights of industrial aecident occurs frequently in reality. For example, somebody is hit by the motor vehicle driving against rules when they are on the way to work or when they are fulfilling the duty. This is typical case, demonstrating the conflicts of work injury insurance and rights violation of third party. This paper discusses this question in the hope of give some guidance to the law application and injury eompensation.
