清代民间调处中的民间社会规范探析

A Study of Non-governmental Social Norms in Civil Mediation in Qing Dynasty

清代民间社会规范是清代不同社会共同体内部形成的一种行为规范,它是清代社会规范的重要组成部分。作为国家法的补充,民间社会规范对清代社会民事法律秩序的维持与实现起着重要作用。清代民间调处与民间社会规范之间有着十分密切的关系。一方面,在清代民间调处中调处人往往会依据某些特定的民间社会规范来解决纠纷;另一方面,清代民间社会规范具有的执行保障机制为民间调处结果的实现提供了某种制度性的保障。

The non-governmental social norms were a kind of norms of conduction formed in different societies in the Qing Dynasty, and they were an important part of social norms in the Qing dynasty. As a supplement of law,they played a significant role in maintaining civil legal order in the Qing society. There were very close relations between the civil mediation and non-governmental norms. On the one hand, the mediator often solved the bothers according to some specific non-governmental norms ;on the other hand,＇the guaranteeing mechanism of the nongovernmental social norms provided the basis for realization of the mediation in the Qing society.
