摘要
《物权法》设定了建筑物区分所有权这一新型物权,但对业主自治管理团体的法律定位却缺乏完善的规定。针对这一现状,在对典型国家关于业主自治管理团体立法例及相关学说进行分析总结的基础上,研究了我国现行法律法规对业主大会法律关系的界定,以及对业主委员会法律地位规定的不足。提出了完善我国业主团体自治管理制度的建议,认为:我国的业主自治管理团体的法律定位构建应从立法层面上承认业主团体的团体性,进而赋予业主委员会"其他组织"的法律地位,明晰业主大会和业主委员会的关系定位,使业主自治组织能够真正发挥作用,从而促进我国建筑物区分所有制度的完善和发展。
Real Right Law of the People′s Republic of China establishes owners′ partitioned ownership of building areas but it fails to define the legal status of the autonomy managerial organization of owners.The present paper,based on an analysis of the system and doctrine about the legal status of proprietor organization in typical nations and on combination with the existing judicial practice in China,studies the present legal definition of the autonomy managerial organization of owners in China.The author holds the point that law should admit the group nature of the proprietor organization,and endow the committee of proprietors the legal status of 'other organizations',and make clear the relationship between the general meeting of proprietors and the committee of proprietors.All of these will help the autonomy managerial organizations of proprietors to play their role and to promote the development and perfection of the system of owners′ partitioned ownership of building areas.
