浅议《合同法》中有关格式条款的规定

On Provisions Related to Format Clauses in the Contract Law

合同中的格式条款因具备附合性特点而不同于普通条款,为此我国在《合同法》中专门针对格式条款作出了特别规定,这些规定涉及格式条款的称谓和界定、格式条款的解释、格式条款的无效及格式条款提供方的特别义务几个方面的内容。本文对这些规定进行了具体分析,指出了部分条款的不足之处,并提出修改建议。

Format clauses are characterized by its attachment features and differentiate from common provisions.Thus,the Chinese government made special provisions in the Contract Law,which are related to the definition,description,explanation,invalidity,as well as special obligations of the term of format clauses.This paper,after carefully analyzing the provisions,points out the inadequacies of certain provisions and offers some suggestions for amendment.
