计算机软件作为一种新形式的技术成果,具有作品形式和产品内涵,其产权保护问题已经成为了当代知识产权保护的重要内容之一。围绕计算机软件这一特殊的知识产权客体,目前有几种重要的知识产权保护的方式,即著作权法、专利法和商业秘密法等对计算机软件的保护。但这几种保护方法都无法完整合理地保护软件权利人的权利。

As a technical product, computer softwares are of property form and implication the protection of which has become a heated issue in the modern intellectual property right law. Effective are protective bills of works, patent, and commercial privacy, which are inefficient in protection of benefit of the owners of computer softwares.
